Kansas Electoral Decision.

Both Roosevelt and Taft Men on Primary Ticket, Court Decides.

    TOPEKA, Kan., July 22.— The question of whether Roosevelt or Taft Presidential electors shall go on the Republican ballot in November must be left to the voters of Kansas and not taken into the courts, and the names of the Roosevelt electors must remain on the primary election ballot, according to the decision of the Kansas Supreme Court, announced to-day in the mandamus action brought by the Attorney General at the request of Gov. Stubbs. The court held that the whole question of Presidential electors should be left to the voters and that no legal questions were involved. The action of Judge Branine of the District Court of Harvey County in taking jurisdiction of the case brought by the regular Republican attorneys to keep the names of the Roosevelt electors off the primary ballot was not wrong, but the Taft attorneys had no cause of action and the injunction proceedings should be dismissed.
    The decision follows the contentions of the Progressive Republicans that the question whether Taft or Roosevelt should be held to be the Republican nominees in Kansas should be left strictly to the voters of the State to decide.
